1.       Scope

The following General Terms and Conditions (GTC) apply to all orders placed via our website. The offer on this website is exclusively aimed at consumers residing in Switzerland (hereinafter "Customer").

A consumer is a natural person who maintains business relations with CHAU's Hype World that cannot be attributed to their commercial or independent professional activity. Orders not in household-typical quantities may be rejected without justification.

CHAU's Hype World reserves the right to change these GTC at any time. The version of these GTC valid at the time of the order shall apply, which cannot be unilaterally changed for that order. Conflicting or deviating customer conditions will not be recognized.

3.       Prices

The selling prices stated on CHAU's Hype World are final prices and include, unless otherwise stated, the statutory value-added tax and any other statutory levies such as advance recycling fees (VRG) or copyright levies for electronic devices. The prices are net in Swiss Francs (CHF).

Any shipping costs will be charged additionally, unless otherwise provided, and must be paid by the customer. Shipping costs are shown separately in the ordering process.

Technical changes, errors and misprints are reserved; in particular, <SHOPNAME> may make price changes at any time and without prior notice. Consultation and support services are not included in the selling prices.

4.       Conclusion of contract

The products and prices on this website are considered non-binding offers.

By placing an order via this website, including the acceptance of these GTC, the customer submits a legally binding offer to conclude a contract. CHAU's Hype World then sends an automatic order confirmation by email, which confirms that the customer's offer has been received by CHAU's Hype World . Placed orders are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.

The contract is concluded as soon as CHAU's Hype World sends an acceptance declaration by email, confirming the shipment of the ordered products or services.

Orders will only be delivered after full payment has been received (exception: delivery against invoice) and provided that the goods are available. If it turns out that the ordered goods cannot be delivered or cannot be delivered in full, CHAU's Hype World is entitled not to accept or execute the order, or only partially. In such a case, CHAU's Hype World will inform the customer by email. If the customer's payment has already been received by CHAU's Hype World , the payment will be refunded to the customer. If no payment has yet been made, the customer will be released from the payment obligation.

5.       Payment options and retention of title

The customer has the payment options indicated in the ordering process.

CHAU's Hype World reserves the right to exclude customers from individual payment options without stating reasons or to insist on advance payment.

CHAU's Hype World may charge default interest of 5% per year and a reminder fee of a maximum of CHF 20.- per reminder in case of late payment by the customer.

The products delivered to the customer remain the property of CHAU's Hype World until full payment.

6.       Delivery, inspection obligation, notice of defects and return

Deliveries will be sent by post or courier service to the address specified by the customer in the order.

CHAU's Hype World endeavors to maintain the shortest possible delivery times. However, any delivery times stated in the order confirmation are non-binding. CHAU's Hype World is entitled to make partial deliveries. In this case, shipping costs will only be charged once to the customer.

The invoice, if delivery against invoice is offered, will be sent by CHAU's Hype World 's choice by email or by post.

If the delivery cannot be delivered or the customer refuses to accept the delivery, CHAU's Hype World may dissolve the contract after notification by email to the customer and after observing a reasonable grace period, and charge the costs for the expenses.

The customer is obliged to check the delivered goods immediately upon receipt of the delivery and to immediately report any defects for which CHAU's Hype World provides a guarantee, in writing by letter or email to the address in the imprint (>Link).

Returns to CHAU's Hype World are at the customer's expense and risk. The customer must send the goods in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects to the return address provided by CHAU's Hype World in the imprint (>Link).

If, upon inspection by CHAU's Hype World, it turns out that the goods show no detectable defects or that these do not fall under the manufacturer's warranty, CHAU's Hype World may charge the customer for the expenses, the return, or any disposal.

7.       Warranty

CHAU's Hype World endeavors to deliver goods of impeccable quality. For defects reported in time, CHAU's Hype World assumes the warranty for freedom from defects and functionality of the item purchased by the customer during the statutory warranty period, generally two years from the date of delivery. It is at the discretion of CHAU's Hype World to provide the warranty through free repair, equivalent replacement, or by refunding the purchase price. Further warranty rights are excluded.

Normal wear and tear, as well as the consequences of improper handling or damage by the customer or third parties, and defects due to external circumstances, are not covered by the warranty. Likewise, the warranty for consumables and wear parts (e.g., batteries, rechargeable batteries, etc.) is excluded.

CHAU's Hype World cannot make assurances or guarantees for the topicality, completeness, and correctness of the data, nor for the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks, and other content. In particular, it is neither assured nor guaranteed that the use of the website does not infringe rights of third parties not owned by CHAU's Hype World .

8.       Liability

CHAU's Hype World expressly reserves the right to change these GTC at any time and to put them into effect without notice.

In the event of disputes, substantive Swiss law exclusively shall apply, excluding conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is expressly excluded.

The place of jurisdiction is Niederlenz or the domicile of the consumer.
