1 User Data Security is a Top Priority

CHAU's Hype Shop respects the privacy of all users of the website and/or online shop (hereinafter referred to as "the customer" or "customers"). This privacy policy forms the basis for the processing of personal data and provides information on what type of user data is collected from customers by CHAU's Hype Shop, how CHAU's Hype Shop uses this data, and what rights customers have. CHAU's Hype Shop complies with applicable data protection laws and processes personal data solely for the purposes for which the data was transmitted.

This privacy policy will be adapted, supplemented, or amended from time to time. With each new visit or access to the website, the currently available version applies.

2 Type and Purpose of Data Collected

The term "personal data" as defined in this privacy policy includes information by which customers can be personally identified.

Processing of personal data means any handling of personal data, such as collecting, using, storing, disclosing, transmitting, or deleting data.

CHAU's Hype Shop automatically collects personal data when the customer interacts with the website or uses the online shop. In addition, personal data provided by a customer (e.g., through contact, creation of a user profile or customer account) is collected automatically or manually.

2.1 Data collected automatically

When visiting the CHAU's Hype Shop website, statistical visitor data is automatically collected regarding which parts of the web offering are visited by the customer. Each time a website is accessed, the web server automatically saves a so-called server log file, which contains, for example, the name of the requested file, the customer's IP address, date and time of access, browser used, operating system, amount of data transferred, and the requesting provider (access data) and documents the access. In this context, it is sometimes necessary to use so-called cookies (see section 4 below).

This access data is evaluated exclusively for the purpose of ensuring trouble-free operation of the site and improving our offer.

2.2 Data during interaction with CHAU's Hype Shop, for contract processing, contact, and when opening a customer account

CHAU's Hype Shop does not automatically collect personal data of customers, such as name, address, telephone number, or e-mail address.

However, personal data of customers is collected when a customer voluntarily provides it as part of an order or when contacting CHAU's Hype Shop (e.g., via contact form or e-mail). Mandatory fields are marked as such, as CHAU's Hype Shop absolutely requires this data for contract processing or for handling the contact request, and without its provision, the order or contact request cannot be sent. Which data is collected can be seen from the respective input forms.

If a customer decides to open a customer account, CHAU's Hype Shop uses the personal data for the purpose of opening the customer account. The mandatory information requested during registration must be provided in full, otherwise CHAU's Hype Shop may refuse registration. CHAU's Hype Shop uses the collected personal data only for the purpose of using the online shop or the respective offer or service for which the customer has registered. In addition, CHAU's Hype Shop may use the customer's e-mail address to inform them about important changes, such as changes in the scope of the offer, or technically necessary changes.

After complete processing of the contract or after deletion of the customer account, the customer's data will be restricted for further processing and deleted after the expiry of tax and commercial retention periods, unless the customer has expressly consented to further use of the data or CHAU's Hype Shop reserves the right to further data use that is legally permitted. The customer account can be deleted at any time either by a message to the contact details provided below (see section 9 below) or via a function provided for this purpose in the customer account.

3 Legal Basis for the Collection and Processing of Personal Data

The legal basis for the collection and processing of the customer's personal data depends in each individual case on the respective purpose of the data processing. In particular, the following may apply:

• the safeguarding of the legitimate interests of CHAU's Hype Shop, provided that the interests of the customer or fundamental rights or freedoms are not disproportionately affected;
• the conclusion or fulfillment of a contract; or
• consent of the customer at the time of collection of personal data. The customer can revoke their consent at any time. For this purpose, the customer can send a corresponding message to the contact details described below. The legality of the data processing already carried out remains unaffected by the revocation.

4 Use of Cookies and Use of Data

4.1 Cookies

To continuously improve the website for customers, CHAU's Hype Shop may use cookies. Cookies are small software information stored by web browsers (e.g., Google Chrome, Internet Explorer, or Mozilla Firefox) on the customer's computer hard drive to facilitate the use of the website (e.g., language selection, shopping cart, etc.).

Some of the cookies used by CHAU's Hype Shop are deleted after the browser session ends, i.e., after closing the web browser (so-called session cookies). Other cookies remain on the end device and enable CHAU's Hype Shop to recognize the customer's web browser on the next visit (so-called persistent cookies). The duration of storage can be found in the overview in the cookie settings of the web browser.

Most web browsers automatically accept such cookies, but web browsers can be configured not to accept or store cookies. However, if cookies are deactivated, the functionality of the website may be limited. Details can be found in the operating instructions or the help function of the web browser.

4.2 Use of data

The anonymized data, which is recorded when the CHAU's Hype Shop website is accessed via cookies, can be used for web analysis purposes, to optimize the website, and to measure performance. CHAU's Hype Shop may use third-party providers for this purpose, some of whom have their own data protection regulations over which CHAU's Hype Shop has no influence.

CHAU's Hype Shop uses functions of the following web analytics services:

Google Analytics

Google evaluates the use of the website to compile reports on website activities and to provide other services related to website usage and internet usage to CHAU's Hype Shop. The IP address transmitted by the customer's web browser as part of Google Analytics will not be merged with other Google data.

The information generated by cookies about the use of the website is usually transmitted to a Google server in the USA and stored there. Google complies with the data protection provisions of the "Swiss-U.S. Privacy Shield" agreement and has registered with the US Department of Commerce for the "Swiss-U.S. Privacy Shield" (information on the Swiss-U.S. Privacy Shield can be found at https://www.privacyshield.gov/Swiss-US-Privacy-Shield-FAQs).

Google Ads and Google Conversion Tracking
Provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

As part of Google Ads, CHAU's Hype Shop uses so-called conversion tracking. When the customer clicks on an ad placed by Google, a cookie for conversion tracking is set. These cookies expire after a maximum of 30 days and are not used to identify the customer. If the customer visits the CHAU's Hype Shop website and the cookie has not yet expired, Google and CHAU's Hype Shop can recognize that the customer clicked on the ad and was redirected to this page.

CHAU's Hype Shop learns from Google the total number of users who clicked on the ad and were redirected to a website with a conversion tracking tag. However, CHAU's Hype Shop does not receive any information that can personally identify the customer.

Google Maps
Provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

CHAU's Hype Shop uses Google Maps for the visual display of geographic information. When using Google Maps, Google transmits or processes data about the use of the Maps functions by website visitors, which may include the IP address and location data. CHAU's Hype Shop has no influence on this data processing.

Insofar as information is transferred to Google servers in the USA and stored there, the American company Google LLC is certified under the "Swiss-U.S. Privacy Shield".

To deactivate the Google Maps service and thus prevent data transmission to Google, a customer must deactivate the Java-Script function in the web browser. In this case, Google Maps cannot be used or can only be used to a limited extent.

4.3 Social Media Content

CHAU's Hype Shop may use social media plugins from social networks, such as Facebook, Instagram, or Twitter, on the website.

If the customer calls up a website that contains such a plugin, the web browser establishes a direct connection to the servers of the respective social network. The content of the plugin is transmitted by the respective provider directly to the web browser and integrated into the page. Through the integration of the plugins, the providers receive the information that the customer's web browser has accessed the corresponding website of CHAU's Hype Shop, even if the customer does not have a profile with the corresponding social network or is not currently logged in. This information (including the IP address) is transmitted by the customer's web browser directly to a server of the respective provider (possibly in the USA) and stored there. If the customer is logged in to one of the services, the providers of the social network can directly assign the visit to the CHAU's Hype Shop website to the profile in the respective social network. If the customer interacts with the plugins, for example by clicking the "Like" or "Share" button, the corresponding information is also transmitted directly to a server of the providers and stored there. The information is also published in the social network and displayed there to the customer's contacts.

These social network platforms have their own data protection regulations, over which CHAU's Hype Shop has no influence.

If the customer does not wish any of these plugins to be loaded, it is recommended to log out of the respective social networks. Furthermore, various web browsers can be set or supplemented with add-ons (e.g., Facebook blockers) so that the social media plugins are not loaded.

5 Newsletter

If the customer wishes to receive a newsletter offered by CHAU's Hype Shop, CHAU's Hype Shop requires the customer's e-mail address and other information that allows verification that the customer is the owner of the provided e-mail address and agrees to receive the newsletter (so-called "double opt-in" procedure). If the customer wishes to subscribe to a newsletter as a registered customer, they can give their consent at the time of registration or later via the registration function in the customer account.

With the newsletter, the customer regularly receives recommendations and offers that might be of interest to them. For this purpose, CHAU's Hype Shop collects and processes personal data regarding the customer's usage behavior on the website, orders from CHAU's Hype Shop, and how the customer uses the newsletter (e.g., whether the newsletter is opened or which web URL links are clicked). CHAU's Hype Shop may evaluate this data for statistical purposes to better tailor the content of the newsletter to the interests of its customers.

The processing of personal data entered into the newsletter registration form is based on the customer's consent, which they can revoke at any time for the future. The revocation can be made either via the "unsubscribe" link in the newsletter, a written notification from the customer to CHAU's Hype Shop at the address listed below, or by unsubscribing in the customer account. CHAU's Hype Shop uses the collected personal data for the content design and dispatch of the newsletters. No data is passed on to third parties for their own (advertising) purposes.

CHAU's Hype Shop stores the personal data provided by the customer for the purpose of receiving the newsletter until the customer unsubscribes from the newsletter.

6 Disclosure of Your Data

CHAU's Hype Shop will not disclose the personal data of customers to third parties. Exceptions to this are when the customer has consented to the disclosure of data to companies not affiliated with CHAU's Hype Shop or when CHAU's Hype Shop is legally, officially, or judicially obliged to do so. This also applies when service providers who support CHAU's Hype Shop in data processing, website administration, or in any other way, as well as in the provision of the products and services requested by the customer, are engaged (e.g., parcel or newsletter dispatch service providers). These third parties are obliged to maintain the same level of security and data protection as CHAU's Hype Shop.

7 Data Security

Unfortunately, data transmission over the internet is not absolutely secure. CHAU's Hype Shop works with service providers and internet providers who take appropriate technical and organizational security measures to protect the personal data of customers. However, CHAU's Hype Shop cannot guarantee the security of the data transmitted by the customer. Any data transmission is therefore at your own risk.

8 Your Rights to Information and Revocation

Of course, every customer is free to inform CHAU's Hype Shop at any time - for example, in an e-mail - that their personal data should not be used for contact in the future. Participation in the special services of the CHAU's Hype Shop website, such as the newsletter service, can also be revoked at any time.

In addition, it is possible to request information about the processing of data or to request a copy of the personal data collected via the CHAU's Hype Shop website.

10 Final Provisions

Should individual provisions or parts of these data protection provisions prove to be void or ineffective, the validity of the data protection provisions as a whole shall not be affected thereby.
